Welcome to Brendan CPA (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our website, services, and any agreements made for accounting, bookkeeping, tax planning, or tax preparation services.

By engaging with our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use our services.


1. Services Provided

Brendan [Last Name] CPA offers professional accounting, bookkeeping, tax planning, and tax preparation services in accordance with New York State laws, IRS regulations, and AICPA professional standards.

Services include but are not limited to:
✅ Bookkeeping – Financial record-keeping, reconciliations, and reporting.
✅ Tax Preparation – Individual & business tax return preparation and filing.
✅ Tax Planning – Strategies for tax savings, compliance, and future financial planning.

2. Billing & Payment Terms

A. Fees & Payments

  • Fees for services vary based on the scope of work and are detailed in the signed engagement letters.
  • Invoices must be paid within 14 days of issuance.
  • Payments will be processed through Intuit or Stripe.
  • Accepted payment methods include:
    ✅ ACH transfers
    ✅ Credit cards
    • Alternative payment methods, such as Venmo or CashApp, are only accepted if explicitly agreed upon before payment is due.

B. Additional Billable Hours & Scope Changes

  • Fees for services are based on the agreed-upon scope of work. If additional complexities arise that require extra time or services, the client will be notified of additional charges before work continues.
  • If the client chooses not to continue after being informed of additional fees, they are still responsible for paying the originally agreed-upon fee for work performed up to that point.
  • Failure to pay for the original agreed-upon work may result in collection actions or legal recourse.

C. Late Payment Policy

  • Late payments may incur a 1% late fee per month until the balance is paid in full.
  • If invoices remain unpaid after 30 days, we reserve the right to pause or discontinue services.

3. Refund & Cancellation Policy

  • Tax Preparation Fees: Non-refundable once a tax return has been prepared and filed.
  • Bookkeeping & Advisory Services: Cancellable with 30 days’ notice, but no refunds for work already performed.
  • Consultations: Fees for scheduled consultations are non-refundable unless canceled 72 hours in advance.

4. Client Responsibilities

By using our services, you agree to:
✅ Provide accurate and complete financial records and tax documents.
✅ Review all prepared documents before submission to tax agencies.
✅ Comply with deadlines for submitting tax-related information.

Failure to provide necessary information in a timely manner may result in delays, additional charges, or non-completion of services.


5. Confidentiality & Data Security

  • All client information is strictly confidential and handled according to AICPA confidentiality standards, IRS regulations, and New York State laws.
  • Tax and financial documents are stored in a secure, encrypted cloud system (ProConnect Tax).
  • We never sell or share personal data, except when legally required by IRS, government agencies, or subpoenas.

6. Liability Disclaimer

  • We provide professional financial services but do not guarantee specific tax outcomes.
  • We are not responsible for tax penalties, audits, or errors caused by incorrect client-provided information.
  • We do not provide legal advice; tax planning services do not replace legal consultation.

7. Account Termination & Refusal of Service

We reserve the right to:
✔ Terminate client accounts due to non-payment, fraud, or policy violations.
✔ Refuse service if a client engages in unethical, illegal, or fraudulent activity.
✔ Discontinue services at our discretion, with written notice provided.


8. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of New York, USA.
  • Any disputes must first be attempted to be resolved informally by contacting support.
  • If unresolved, disputes must be settled through binding arbitration in New York, USA.

9. Updates to These Terms

We may update these Terms at any time. Clients will be notified of significant changes via email or website notice. Continued use of our services after changes constitutes acceptance of the updated Terms.
